Right, I'm actually going to find this difficult to publish, but it's reality, and so be it, if I've swallowed my pride.
I decared myself bankrupt in July 2009, following years of constant arguments, letters and fights with creditors. I'd just had enough. And before anyone implies this is an easy way out, that is to the contrary.
Anyway, getting back to Santander...Bankruptcy order made July 2009, notice of discharge December 2009. To cut a long story short, I receive a letter and a default notice in April 2010 making all the usual threats.
Not only is this annoying, but it is also against the law. Creditors are prohibited from making contact with debtors, no matter how trivial. I sent the correspondence to the Official Receiver, as required, and thought that was that...Until June 2010, when the same letters arrived on the doormat, same letters, same outstanding balance and arrears, but a different date.
Is it me, or do some companies just have utter contempt for the rules and regulations on debt collection. This is a serious matter, and no matter what opinions surrounding debtors are; there is absolutely no justification for breaches of the law.
Previuosly known as abbey. They pushed me into a credit card application and loan which I tried to give them the money back and they replied they were not prepared to help. The issue was I have a mental health problem they are aware of and still pushed the loan. They put my employer down as the dwp dla rather than none as in income support. Told me they were acting in my interest and saving me money when infact the 7.9 loan was actually 23.9. Whilst I have responded to all communication from them and had to change banks due to the behaviour of their internal collections department, which incidently untill you pull your teeth out with the stress, will not admit they are part of the bank, when they are. I often wonder is that so they can dissasociate the brand name with the threatening behaviour of their own collections dept.
Any how as they wont respect I am mentally ill or offered help over cancelling the loan on that matter along with them accidently paying out a cancelled cheque I had stopped at the same time as cancelling dd and so, they although apologised about it did nothing and charged monthly interest and so on and so on.
I approached the fos and my complaint to abbey was closed without my knowledge and told they coudnt do anything as already filed it away. That was quick.
Although they passed the accounts then to external dcas and then recalled them due to ongoing complaint with the fos and reassured me it was on hold and I was not going to be harassed again, they allowed their collections dept to chase again.
Rang today to be told what they told me only a week ago was false and that they were entitled to chase me as complaint closed their end and with the fos. I said I was suprised at this and was told it was the case and therfore to expect the debt agencies to start once more.
SHAME FOR THEM THAT THE FOS HAVE TOLD ME THE COMPLAINT IS STILL VERY MUCH ONGOING AND THAT THEY SHOULD NOT HAVE TOLD ME IT WAS CLOSED.
Point to my rant is to avoid them like the plague whatever is their new name. They are the same company who allowed a customer with two bank accounts, insurance with them and a savings account all running fine to fall apart due to them forcing products down my throat and when asked for help they did nowt. On my subject access request from them there is a comment, mrsxxx states she has mental health issues, response not our problem. It seems it wasnt their problem when I told them and they carried on with their sales pitch, not their problem when I asked for help and to accept the money back and not their problem when told they should not be harssing me whilst the fos are involved.
Santander or abbey do not treat mentally ill customers with dignity or fairness and should be avoided at all costs because they have cause me untold distress from the chasing and reminding them of what they are doing from one department to the next, is not liasing with each other, whilst they are happy to harass me and ignoring the very lending code they signed up to.
Will update when get result from the fos in time.
For anyone not in my position who maybe thinks why did she just not say no and walk out, I tried and they peruaded me I would be silly not to listen to the savings they could find. Anyone who has a friend or family member with mental health issues would understand the pressure I felt and why after saying no more than once I couldnt get the words out again. I did my best to get them to help me because of my health and take the money back, they told me to go back to the branch, I did and was refered back to a phone on the wall to speak again to customer services. Hence my name loopin louie feels like I am on a non stop roundabout xxx
