"Another option is to contact a 3rd party to manage your debt for you. Whether this be Citizens Advice Bureau or the Consumer Credit Counselors these companies can help you come to an amicable decision on your debts. Try to avoid debt management agencies as these company's will pay one pound per month while managing your finances. But this service is not free so why not use that money towards the debt? Paying this amount off your debt only leaves longer for you to worry about it in the long run, for instance if a late payment fee is applied of twelve pounds because you defaulted on a one pound payment, twelve months worth of payments have been negated.

When you call Moorcroft if you treat the collectors with respect they will return it and if you simply go through your financial circumstances over the telephone an amicable decision will be the result of the call.

Any queries don't hesitate to post a question or reply here and thanks for reading."

In my case I did, but that didn't stop Moorcroft from sending me letters, so such advice really doesn't wash. I've now ended up declaring myself bankrupt. Sadly, that has been the only way to make my creditors stand up and take notice. They had every chance to resolve the debts amicably because i always co-operated with them. Unfortunately they decided to push their luck, so I took the ultimate step.

Aah. My old Muckers at Moorcroft

Im not sure if you've noticed that on their letterhead, it says 'Moorcroft Debt Recovery plc' - PRE-COURT DIVISION

This is actually illegal, as it is a mis-representation. It can be seen by some, that Moorcroft are in partnership with the courts. This is not the case. Don't feel intimidated

I recently had a letter from Moorcroft by where the debt was passed to them from Bham City Council, there was an overpayment made on behalf of BCC and this is still in dispute from nearly 4 years ago!! the debt is now with Moorcroft who are making my life a misery, i am currently writing tot he tirbunal who have no jurisdiction on what BCC erros are made, surely there must b e site similar to this in realtion to Bham City Councils errors and blunders in pursecuting innocent people.

Incredibly rude staff, not helpful in the least, and not prepared to advise me on how best to reduce my debt.

OK, heres our story.

I had a Bank of Scotland credit card. It was never fully paid off, but no paymanet were ever late/missed. My CC balance was never over the limits. It was run like 90% of CC accounts.

The card was then passd over to the MBNA. Within 6 months the requested repayments had doubled and the interest on the account had quadrupled!!!! By then, the interest charged was more than the requested payment. We could not keep this up, as the MBNA had subk their claws into ust about every CC we had. Our overall debt to all our creditors has increased from £30k to over £90k in 8 months, just because of the MBNA's interest charges.

So, we went to the CAB.

The CAB in an (understandably short) appointment/meeting gave us a fact pack which included an income and expenditure form. We filled this in and sent it to all our creditors. Quite a few accepted our offer sraight away.

Moorcroft, however didnt.

I have lost count of the income and expenditure forms we have sent off, thats "didnt arrive". Naturally, while this was happening, we were being threatened via letter and phone. Finally, due to my perseverance and posting method, they "officialy" recieved our form and offer of repayemnt. It wasnt good enough, acording to them. They wanted more. I pointed out to them, that we had used the same pro-rata formula (as we were told to by the CAB) that the county courts used, so if they took us to court, they woundnt get any more off us.

Naturally, around christmas time the post goes a little strange, so our cheqye payments to them "went missing", that had not ben cashed my Moorcroft. The bank stopped the cheques and we posted out replacement that same day (via recorded post - which they recieved the next day).

We recieved a letter back - suprise suprise - saying that we had not sent payment and that it was illegal to send a cheque out that couldnt be cashed (this is, of course, twaddle).

Over the last few years, we have had to deal with quite a few DCAs and Moorcroft are the worst.

Here are my tips with dealing with them, any other DCAs and debt in general...

DO NOT consolidate your loans or remortgague your home. This makes things far worse.

Go to your local CAB - get there early, their services are highly sought after and very limited.

Do what the CAB say.

No matter how much moorcroft or any other DCA pester, do not give in and increase your payment, that extra money has to come from somewhere. As long as you are making a regular payment - even if its jusy 10p - you cannot be successfully taken to court, as you can say that you are making regular payments, its just not what the CDA want.

DO NOT communicate with any DCA via phone. Ignore thier calls. Communicate ONLY via letter. That waay you have hard evidence of what has been said, agreed. Make this point in every letter you send. It goes without saying to keep all correspondence - both inward and outward.

Answer every letter, this way you are showing that you are doing everything in your power to clear your account and not ignoring the problem.

If you do answer they phone to them by accident, do not get side-tracked into discussions about how this debt came into existance. Stay on topic. Dont forget you can put the phone down at anytime.

Above all that, remember, no matter how it feels, you are in control of your money. It is up to YOU who gets paid and how much.
