knowing a little law helps, this company instantly added a penalty charge to my alledged unpaid 1 month due membership (which is disputed) - LA fitness, cancelled membership due to environmental health having to be called for colchester club (went through usual complaints). Penalty charges are illegal and there is much case law to use, especially when the charges are higher than alledged debt. Also If you dispute a debt (in writing preferably) then by law they cannot hassle you by phone until investigations have been made. Send correspondance by recorded delivery as they very low and claim they don't receive letters. They can only in law follow process of taking you to small claims (they seem to only deal with small debts). Small claims court don't allow huge costs for solicitors etc so dont be scared by this. The SMC is designed to be low cost. I have just received a solicitors letter myself, which I believe was written by ARC purporting to be this company, looks legimate to untrained eye but only has a po box number and advice to call arc and not solicitor (I found the solicitors number by simple search on google). If so this company has broken another serious law, will check tomorrow, if so it will be closed down but I imagine it will re-open with another name arc (world) perhaps LTD (i haven't done a history check), sadly it is easy to re set up for anyone. btw - county court judgements only go against you if they judge against you AND the defendant has the right to have the case heard in a local court, call citizens advice and they will tell if you have a good case but sadly most people just pay up "its only £x" so these guys win and stay in business.
