I received a letter from Lowells last week asking me to 'contact then with a view to paying off my debt'. Now, since May of this year, I have had a Debt Relief Order (DRO) which means any creditors I have listed on the order can no longer pursue me for their debt. Only one company, Littlewoods catalogue, has ignored this, despite being informed by both myself and the Insolvency Service the they cannot chase me for payment. With the letter I received from Lowells, in the same envelope, was a letter from Littlewoods informing me they had 'legally sold' my debt onto Lowells. As far as I know, once a DRO is in place creditors can no longer sell any debts on to a third party, it is a breach of the DRO. I have contacted the OFT to see what they suggest but in the meantime should I ignore Lowells letter, or write and tell them they cannot pursue me for this debt and I have reported them to the OFT for doing so?

This is a story of my experience with Lowell’s. About a year ago they sent me a letter demanding £3000 for a debt on a credit card. However I have only ever had 2 cards one of which is paid off and the other still in use. I queried this with them over the phone and the drone passed it to the fraud team. All sorted or so I though, however a few months ago I learned that passing it to the fraud teams means putting it to the bottom of the pile and trying again later. They sent another letter making the usual threats so after advice from a few sites I asked them to provide proof of the debt. In reply I got a letter worded a lot like one of the posts from mr humpty “IF YOU SPEND IT PAY FOR IT!” trouble is I didn’t spend it so why should I pay for it. The end the letter saying that it would be passed to there legal team Mackenzie Hall. Now Mackenzie Hall are a part of Lowells and are not solicitors or lawyers instead it is a trade style. What that means is that they pretend to be solicitors (without claiming to be solicitors as that would be illegal) and try to scare you into paying. Anyway I replied telling them again that I wanted proof of debt and that any correspondence from them that is not proof of debt or an apology and acknowledgment that the matter is closed I would report them to the OFT. The result was an immediate cessation of threatening letters. Moral of the story ask them for proof of debt, from what I have read on other sites even if your own debt with them is real they are still unable to provide any proof that the debt is real. Also do not sign anything you send to them, print your name only this is so they can use your signature fake a CCA.
